Digital Prints On T-shirts, LLC. (“we”, “our”, “us” or “Digital Prints On T-shirts”) respects the privacy of its users and is fully committed to protecting their personal data and using it in compliance with data protection laws. This Privacy Policy describes how we collect, use, and process personal data that we obtain from you, or that you provide to us, in connection with your use of our website (digitalprintsontshirts.com), our apps, our print-on-demand services, and other services (collectively, the “Services”). Our services are not directed to minors (typically 18 or 19 years old, but up to 21 years old, depending on the jurisdiction), especially children (under 13 years old under the U.S. Children’s Privacy Protection Act (COPPA) or under 16 years old under the European Union’s General Data Protection Regulation (GDPR). We do not knowingly collect, store, disclose, or sell personal data from underage users or children.
Use of the Services by minors is not permitted under the Terms of Use. We offer services to both our enterprise customers and directly to end users.
If you use our Services solely for your personal use, you will be considered the “User” and, for the purposes of Data Protection Laws, we will be the “controller” of the data or the covered “company”, as such terms are defined in applicable Data Protection Law.
If you use our Services to fulfill orders and deliver products to third parties, you are considered a “Merchant.” When processing the contact details, payment information and other information detailed in Section 1 below, directly relating to the Merchant, we are the data controller or the entity subject to such processing. When we act on behalf of a Merchant to fulfill an order from its end customer, we are a “data processor” or a “service provider” as these terms are defined in applicable data protection law. In these cases, we process the information in accordance with our Data Processing Terms (in accordance with the Terms of Service) on behalf of our customers.

The type of personal information we collect and process about you depends on how you interact with us and our Services.

- Legal basis: Consent (for opt-in marketing) or legitimate interest (for communications with existing customers). Your SMS subscription data is never shared with third parties for their own marketing campaigns; They are only shared with service providers who help us send you our messages.
- Data collected: Identifiers, commercial information, unique and device identifiers, and geolocation data.

Security, fraud prevention and legal compliance
Protecting our platform and complying with the law is a priority.
- Purpose: Detect and prevent security issues and fraudulent transactions, investigate malicious activity, enforce our Terms of Service, and comply with legal mandates (such as DMCA requests or financial penalties).
- Legal basis: Legal obligation and legitimate interest (to ensure network security and prevent harm).
- Data collected: Identifiers, device and unique identifiers, and commercial information.

- Information collected about the end customers of our business
In the course of providing products and services on behalf of our merchants, we collect and process certain information about individuals at the direction of such merchants (“End Customer Data”). Historically, End Customer Data has included information such as personal data relating to the end user of our Services, any personal data in printed content (where applicable), personal data disclosed during the use of any of the Services, including name, email address, telephone number, shipping address, and other information about the merchant’s end customers.
If you are an end customer of the Merchant (end user of our Services), the Merchant is the controller of your personal data and must inform you about how such data is collected and processed when using our Services. For more information, please refer to the Merchant’s privacy policy. The Merchant is your contact for any queries regarding the processing of your personal data.
- Sharing personal data with third parties
To provide the best possible experience, we often need to collaborate with third parties. The following are the types of third parties with whom we share information in connection with your use of the Services:
Service Providers. In order to provide our services to you, we work with third parties who perform services on our behalf and with whom we share personal data to support our services (“Service Providers”). LLC service providers include:
- Web, online, and security hosting services.
- Manufacturing and logistics services. Email and messaging service providers.
- Payment processors and fraud prevention services. Analytics and marketing providers.
We will only share personal data with service providers who have committed to comply with obligations set out in applicable data protection laws.
Legal Advisors. To the extent reasonably necessary, we may be required to share information with third parties to (1) comply with legal requirements or requests, including subpoenas, claims, disputes, or litigation, (2) protect our legitimate interests or those of a third party, (3) enforce or apply our agreements; and (4) protect our or others’ property or safety.
Affiliates. We may share your personal data with our affiliates (companies that are part of our corporate group).
Business customers (i.e. merchants). When we provide services on behalf of merchants, we will provide them with certain information related to your orders and purchases. We may also share information with merchants if we are processing a DMCA takedown request or facilitating an appeal process.
In a business transfer, we may disclose or share your information as part of a corporate business transaction, such as a merger or acquisition, joint venture, corporate reorganization, financing, or sale of business assets, or in the unlikely event of insolvency, bankruptcy, or receivership, in which case such information may be transferred to third parties as a business asset in the transaction.
Facilitation of applications. We share information at your request or direction, such as when you choose to share information with a social network about your activities when using the Services.
Notwithstanding the foregoing, we may share information that does not identify you (including information that has been aggregated or anonymized), except where prohibited by applicable law.

- Data Retention
We may retain your personal data for as long as you maintain an account or for as long as any of the legal bases for processing personal data above exist. For example, if you unsubscribe from our marketing emails, newsletter or blog, we will no longer process your personal data for such purposes.
If you have used our Services without creating an account, we will retain your personal data for as long as necessary to comply with our legal obligation to retain information relating to the provision of services, for example, for tax purposes.
After you end your relationship with us by deleting your account or ceasing to use our Services, we may continue to store copies of your personal data (and, in the case of Merchants, your customers’ personal data) to the extent necessary to comply with our contractual obligations to Merchants and legal obligations, as well as to resolve disputes between you and us (or between Merchants and applicable customers), to prevent fraud and abuse, to enforce our agreements, and/or to protect our legitimate interests (to the extent applicable law permits us to continue storing copies to protect our legitimate interests).
We reserve the right to retain usage data related to our products and services, as well as data that has been anonymized and/or aggregated, to the extent permitted by applicable laws.
- Information Security
We strive to use reasonable organizational, technical, and administrative measures to protect the confidentiality, integrity, and availability of personal data.
Our LLC measures include implementing appropriate access controls, investing in the latest information security capabilities to protect the IT environments we use, and encrypting and anonymizing personal data whenever possible. Access to information is restricted to our employees and agents who need it for the performance of their duties.
We recommend that you take care of the personal data you handle online and that you establish strong passwords for your account, as well as that you limit access to your computer and browser by logging out once it is over.

- Count.
You may access, update, or delete certain information that you have provided to us through your account or by sending an email to the address listed in the Contact Information section below. We may ask you for additional information to confirm your identity.
- Communications.
- Emails. You can stop receiving promotional emails at any time by following the instructions in the emails and clicking on the unsubscribe link. Please note that you cannot unsubscribe from emails that are not promotional, such as those related to your account, transactions, service, or our business relationships (e.g., terms and conditions).

- Additional Information for European Residents
If you are a user or data subject of a merchant located in the European Economic Area or the United Kingdom, you have certain rights with respect to your personal data in accordance with European Union and United Kingdom data protection laws (hereinafter referred to as the “GDPR“). If you are a user or data subject located in Germany, you have certain rights under both the GDPR and the Federal Data Protection Act (“BDSG”). Under BDSG, residents have certain rights over the personal information (as capitalized BDSG is defined) that we have collected about them, which are described in more detail below.
- Roles
The GDPR distinguishes between organisations that process personal data for their own purposes (referred to as “controllers”) and those that process personal data on behalf of other organisations (referred to as “processors”). As described in the “Background” section above, we may act as a controller or processor depending on the circumstances.
We as Data Controllers: We are the “controllers” of data when we process information directly from Users to provide our Services, such as a User who has used the specific Services.
We as Processors: We are processors, acting on behalf of a merchant to manage an order from their customer. Acting as processors, we process information in accordance with our Data Processing Terms (as per the Terms of Service) on behalf of our customers.

Our LLC legal bases include the following instances: (i) you have consented to processing for one or more specific purposes, either to us or to our service providers, partners, or customers; (ii) the processing is necessary for the performance of a contract with you; (iii) the processing is necessary for compliance with a legal obligation; or (iv) the processing is necessary for the purposes of the legitimate interests pursued by us or by a third party, provided that your interests and fundamental rights and freedoms do not override our interests.

We do not use sensitive personal information of California residents for any purpose other than that is not permitted by the CCPA. Specifically, we do not use sensitive personal information of California residents to obtain characteristics about them.

We may use automated decision-making technologies, algorithms, for fraud prevention, security monitoring, and data analysis. These processes do not create legal or other significant effects for you. We offer our Users and Merchants certain discount opportunities that may be considered a “financial LLCentive” or a “legitimate loyalty program” under applicable Data Protection Laws (the “Program”). Such a Program may include discounts or coupons that are given when you sign up to receive them, which generally requires you to provide your name and contact information (such as your email address), or to participate in a survey. We consider the value of your personal information to be related to the value of discounted products or services, or other benefits you obtain or provide to you in connection with the Program, less the expenses we incur in providing such opportunity.

- Additional Information for Residents of States with Stricter U.S. Privacy Laws
Under certain U.S. state enhanced privacy laws, applicable residents have specific rights with respect to the data we have collected about them. This notice describes how we collect, use, and share your personal data in our capacity as a “controller” under the respective U.S. Enhanced Privacy Law, and the rights you have with respect to your personal data, including sensitive personal data. For the purposes of this section, “personal data” and “sensitive data” have the meanings given to them in the respective U.S. Enhanced Privacy Law and do not include information excluded from such law. Generally speaking, personal data is information that can reasonably be attributed to an identifiable individual.

In addition, we may collect and/or use other types of information after notifying you and obtaining your consent, to the extent such notice and consent are required by the strictest privacy laws in the United States.
- Your Rights Under U.S. Enhanced Privacy Laws
If you reside in a state with a U.S. Enhanced Data Protection Law, the processing of certain personal information about you may be subject to such law. Where the U.S. Enhanced Data Protection Act applies, this section provides additional privacy information and informs you of your additional rights as a resident of that state. We will never discriminate against you for exercising your rights, including providing you with a different level or quality of services or denying you goods or services when exercising your rights under a U.S. Enhanced Data Protection Law.
- Right of access to information/Correction of inaccurate personal data. You have the right to request access to the personal data we collect about you and information about the purposes for which we collected it, as well as the third parties and service providers with whom we share it. In addition, you have the right to correct inaccurate or complete personal data. You may submit such a request as described below. If you reside in Oregon or Minnesota, you also have the right to request a list of the specific third parties to whom we have disclosed your personal data.
- Right to erasure of personal data. In certain circumstances, you have the right to request that we delete personal data that we have collected directly from you. You may submit such a request as described below. There may be a legal reason why we are not required to honor your request, or why we honor it more narrowly than you expected. If so, we will explain this to you in our reply.
- Right of rectification. You have the right to ask us to correct, or to provide you with a means to correct, the personal information we have collected about you, with certain exceptions.

If we are unable to verify your identity, we may deny your request for access or deletion of data.

If you believe that we are transferring personal information to a third party and that the third party is using it in a way that exceeds the processing that third party performs on our behalf as a service provider or processor (as these terms are understood in applicable law), please contact us at the address listed in the “Contact Information” section so that we can investigate the matter.
- Right to portability
If you wish to receive your personal data in a machine-readable format, please contact us at the address given in the “Contact Information” section. We may provide you with instructions on how to access and download your information yourself, or we will work with you to provide your personal data in accordance with applicable data protection legislation.
If applicable data protection laws do not grant you the right to portability, we may deny your request.
- Authorized Agents
Residents of California, Colorado, and Connecticut may designate an authorized agent to submit a request on their behalf to access or delete their personal information. Use of an authorized agent must comply with the CCPA and the U.S. Enhanced Privacy Act, as applicable, which includes that you must provide the authorized agent with a written, signed authorization to submit such a request. Please note that we may deny a request from an authorized agent who does not provide proof that you have authorized them to act on your behalf. We will still need to verify your identity directly with us in accordance with applicable law.
- Respond to requests as a controller or covered company
Once we receive your request, we will review it, determine whether we can verify your identity, and process it within the timeframe set by applicable law. We aim to comply with all verified requests within 45 days, in compliance with the CCPA and most of the strictest U.S. privacy laws, unless we need to respond sooner. For example, if you reside in Europe, we aim to respond within 30 days, as required by law. If necessary, extensions may be requested, as permitted by applicable law (usually an additional 45 days), which would be accompanied by an explanation of the reason for the delay.
Please note that, as permitted by applicable law, we may charge a reasonable fee for multiple requests made in a single 12-month period.

If we have processed your personal data on behalf of a merchant and you wish to exercise any of your rights in relation to such data, please contact that merchant directly.
