These Terms of Service ("Terms") govern your access to and use of our website located at https://digitalprintsontshirts.com/ (the "Website"), as well as all products, features, online tools, and printing services provided by Digital Prints On T-shirts ("we," "us," or "our").

By accessing our Website, creating an account, uploading artwork to our Online Design Editor, or placing an order, you agree to be legally bound by these Terms, along with our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue the use of our Website and services.

1. OVERVIEW AND SCOPE OF SERVICES

Digital Prints On T-shirts operates a custom print-on-demand service specializing in apparel and merchandise. We utilize advanced printing and decoration technologies, including Direct-to-Film (DTF), Direct-to-Garment (DTG), Sublimation, and Embroidery.

Our Website offers an interactive Online Design Editor that allows individual customers, businesses, and organizations to customize products, upload logos and artwork, preview designs, and place custom orders with no minimum order requirements.

2. ELIGIBILITY AND ACCOUNT RESPONSIBILITIES

Age Requirement: You must be at least 18 years old or the legal age of majority in your jurisdiction to use our Website, register an account, or complete purchases. By placing an order, you represent and warrant that you meet this age requirement.

Account Creation and Security: When creating an account, you agree to provide accurate, complete, and current information. You are solely responsible for protecting your account credentials and password. Any actions performed through your registered account are your legal responsibility. You must notify us immediately at files@digitalprintsontshirts.com if you suspect unauthorized access to your account.

3. INTELLECTUAL PROPERTY AND USER CONTENT

Ownership of Uploaded Content: You retain all ownership rights, copyrights, and intellectual property to any artwork, logos, graphics, images, and text ("User Content") that you upload or submit through our Online Design Editor or customer service channels.

License Granted to Us: By submitting User Content to Digital Prints On T-shirts, you grant us a non-exclusive, worldwide, royalty-free, fully paid, and transferable license to use, reproduce, modify, scale, display, and process your artwork solely for the purposes of fulfilling, printing, packaging, and shipping your order.

Customer Intellectual Property Guarantee: You represent and warrant that you are the creator and owner of the User Content, or that you hold all necessary licenses, permissions, trademarks, and written authorizations from copyright holders to reproduce and print the artwork provided.

Indemnification for IP Infringement: You agree to indemnify, defend, and hold harmless Digital Prints On T-shirts, its owners, employees, and affiliates against any legal claims, demands, lawsuits, liability, damages, and costs (including attorney fees) arising from allegations that your uploaded User Content violates the copyright, trademark, privacy, or proprietary rights of any third party.

Prohibited Content Policy: We strictly prohibit content that contains unauthorized copyrighted or trademarked materials. We also reserve the absolute right to refuse or cancel any order that contains hate speech, sexually explicit imagery, defamation, harassment, illegal material, or content promoting violence.

4. CUSTOM ARTWORK, PRINT QUALITY, AND COLOR DISCLAIMERS

File Quality and Resolution: You are exclusively responsible for the quality, resolution, dimensions, color profiles, and transparent backgrounds of the graphics submitted. For optimal DTF and DTG results, files should be high resolution (300 DPI) in PNG format with a transparent background. Digital Prints On T-shirts is not responsible for blurry, pixelated, distorted, or poor print outcomes caused by low-resolution files provided by the customer.

Color Variations (RGB vs. CMYK): Digital computer, tablet, and mobile screens render images using RGB color spectrums, whereas physical textile printing uses CMYK inks and pigments. Due to variations in screen calibration, garment fabrics, and textile ink absorption, minor color variations between the screen preview and the physical printed garment are normal and unavoidable. You acknowledge and accept these minor variations.

Sizing and Placement Tolerance: Garment mockups generated by our Online Design Editor serve as visual guidelines. Minor variance (+/- 1 inch) in design size, orientation, and placement is normal in manual textile printing and will not be considered a manufacturing defect.

5. ORDERS, PRICING, AND PAYMENTS

Pricing and Currency: All prices displayed on our Website are in U.S. Dollars (USD). Prices, product descriptions, and shipping costs are subject to change at any time without prior notice.

Payment Processing: Full payment (including product price, applicable sales taxes, and shipping fees) is required at the time of purchase. Orders will not enter our production queue until payment authorization is completed. We accept major credit cards and electronic payment methods supported on our Website.

Order Modifications and Cancellations: Due to our fast automated production process, orders begin processing shortly after payment. If you need to revise artwork, change garment sizes, or cancel an order, you must contact us immediately at files@digitalprintsontshirts.com. Once an order has entered the printing or preparation phase, it cannot be canceled, refunded, or modified.

6. PRODUCTION TIMELINES, SHIPPING, AND DELIVERY

Production vs. Transit Time: Total estimated delivery time consists of Production Time (the working days required to print your items) plus Shipping/Transit Time (the time taken by shipping carriers to deliver your package). Production estimates are non-guaranteed targets.

Shipping Addresses and Delivery Responsibility: We ship orders using third-party logistics carriers. You are responsible for providing a complete, accurate, and deliverable shipping address at checkout. Digital Prints On T-shirts is not responsible for delayed, lost, returned, or stolen packages resulting from incorrect addresses provided by the user or carrier delays beyond our direct control.

7. RETURN, REPLACEMENT, AND REFUND POLICY

Because all garments and merchandise are custom printed on-demand specifically for you, our return policy is governed by strict rules:

Non-Refundable Custom Products: Custom printed items cannot be returned, exchanged, or refunded for buyer’s remorse, incorrect garment size selected by the customer, or design/spelling errors made by the user in the design editor. Please review size guides and design mockups carefully prior to completing payment.

Defective Items and Production Errors: If your package arrives damaged, or if your items contain a verifiable manufacturing defect or severe printing error caused by our team, you must notify us within 10 calendar days of delivery.

Claims Process: To submit a defect claim, email files@digitalprintsontshirts.com within the 10-day window with your order number and clear photographic proof of the defective product and printing error. After reviewing and verifying the defect, Digital Prints On T-shirts will promptly reprint and ship a replacement item at no additional charge, or issue a refund or store credit at our sole discretion.

8. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Website and Service Availability: Our Website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that our Website will operate uninterrupted, error-free, or fully secure at all times.

Limitation of Direct and Indirect Damages: To the maximum extent permitted by applicable law, Digital Prints On T-shirts, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, lost business opportunities, data loss, or damages resulting from your reliance on customer-uploaded files or website downtime.

9. SEVERABILITY AND ENTIRE AGREEMENT

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the complete legal understanding between you and Digital Prints On T-shirts regarding the use of our Website and services, superseding all prior oral or written communications.

10. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by, interpreted, and construed in accordance with the laws of the State of California, United States, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding arising out of or relating to these Terms shall be filed exclusively in the state or federal courts located in California.
